Twitter, WordPress, Ning, and GoDaddy Sued Over Defamation – Section 230 Anyone?

Online giants Twitter, WordPress.com, Ning and Godaddy were faced with an interestingly misdirected lawsuit last Wednesday when Daniel Neiditch, President of the Board for Atelier Condos on West 42nd Street in New York City, filed a lawsuit that included the four companies as defendants.
Neiditch filed suit against two condo owners and three former employees alleging they published defamatory statements on various websites, blogs and on Twitter against him. The lawsuit was filed in New York Supreme Court, New York County.
The case itself wouldn’t have come to our attention on its own – it’s standard stuff – it involves accusations of “murder, bribery, extortion, illicit payoffs, and corruption.” What’s interesting is that Neiditch and his lawyers also sued Twitter, WordPress.com, Ning and Godaddy for hosting/providing the domain name for the defamatory content.
Obviously someone forgot to tell Mr Neiditch’s lawyers about Section 230 of the Communications Decency Act which grants interactive online services broad immunity from legal liability including defamation as a result of content created by others.
In a similar case back in January where a dentist sued Yelp because he was unhappy with a customer’s review – the dentist’s lawyer admitted he “wasn’t aware” of Section 230 when he filed suit and quickly dismissed the case against the review site.

These types of lawsuits drive me absolutely crazy. Just goes to show you how childish someone can be thinking they’re entitled to have as many people suffer from their own inability to cope with someone else’s opinion.
