Dubai Firm Fails In Reverse Hijacking Attempt
Posted on December 9th, 2009 by admin in Domain News | No Comments »
Dubai-based law firm Bin Shabib & Associates has failed in an attempt to win the domain name BSA.com via UDRP.
A UDRP arbitration hearing in November this year found that the firm had engaged in Reverse Domain Name Hijacking in its attempt to get the domain name from Shanghai-based Hebei IT.
The complainant claimed that the term BSA is short for Bin Shabib & Associates and that it has applied for the registration of BSA as a trademark with the UAE Ministry of Economy. It also provided evidence in the form of letterhead and stationery of Bin Shabib & Associates and pointed to the use of the term in it’s current website BSA.ae.
The respondent on the other hand stated that no evidence was presented that establishes use of “BSA” as a mark and that the complainant based its whole case on “a blank piece of stationary and its website”.
Following the UDRP decision, BSA.com remains the property of Shanghai-based Hebei IT.
